With the National Commission for Women (NCW) slated to table its report on the Air India molestation case today (November 3), commission sources have told a private news channel that the Airhostess Komal Singh’s version of events is correct. Sources add that the Air India pilot was in the wrong.

This result would be contradictory to the assessment by Air India’s own five-member panel, which on October 30 dismissed with surprising alacrity the complaint filed by the air hostess that she was molested by a commander in the course of a spat on board IC 884 on October 3 while flying from Sharjah to Delhi.

While the panel apparently took into consideration the complainant’s alleged history of indiscipline and ‘habitual’ levelling of charges against colleagues, the NCW probe report, sources say, bases its findings on the medical test conducted on the air hostess, which found evidence of physical assault.

The NCW is fact finding recommendatory body – and like most commissions, as per the statute it can recommend specific actions to the concerned authorities. Legally speaking, the commission after tabling its report could be expected within 10 days to make a recommendation to the police and the airline to take necessary action.

For the police this would entail registering a case against the accused, and for air line perhaps, a review of its earlier probe findings.

Whether the AI or police actually follow through on the NCW’s recommendations, remains to be seen.

Air India air hostess Komal Singh had accused Capt. Arora of molesting and assaulting her after an altercation in the cockpit, and also cited sexual harassment.

Earlier on October 30 Air India had given a clean chit to Arora, claiming that the charges levelled by Komal Singh against the pilots were ‘absolutely baseless’ and the harassment charge levelled by the Air hostess was an afterthought and a ‘planned and rehearsed strategy’. Besides dismissing her charges, AI had issued a charge sheet against Komal Singh for violation of the conduct rules and for not complying with the company policy.

What appears to have helped a five-member panel to make up its mind on the complaint is an alleged history of indiscipline and habitual levelling of charges against colleagues by Singh, Khanna and their friend Chhavi Agarwal, also an airhostess.

Despite Komal’s recent setback, NCW chairperson, Girija Vyas came out in support of Komal saying Air India could not dismiss the case against Captain Arora.

The Commission’s sub-committee on October 14 began investigating the mid-air scuffle on Air-India’s flight IC-884 earlier this month, in response to a complaint lodged with the commission by Komal Singh. Vyas said there were two aspects to the case – the woman was allegedly harassed and then there was a case of possible negligence, which had to be investigated separately.

The NCW also said it was concerned over the number of complaints from women airline crew members on lack of pay parity and sexual harassment at workplace, and would soon come out with guidelines to ensure better working conditions.
